Terms of Service

Welcome to NativeMade ("NativeMade," "we," "us"). NativeMade is a benefit corporation marketplace exclusively for verified Native American artisans. By creating an account, browsing, purchasing, or selling on nativemademarket.com (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to create an account. Sellers must be verified Native American artisans and must accurately represent their tribal affiliation and the origin of their work. NativeMade reserves the right to verify, suspend, or remove accounts at its sole discretion.
2. Account & Security
You are responsible for maintaining the confidentiality of your credentials and all activity under your account. Notify us immediately of any unauthorized use.
3. Marketplace Role
NativeMade provides a venue connecting buyers with independent verified Native American artisan sellers. Sellers — not NativeMade — are the merchants of record for the items they list. NativeMade is not a party to the contract of sale between buyer and seller, except as expressly stated.
4. Listings & Authenticity
Sellers represent and warrant that all listed items are personally handmade or directly produced by the seller, and that all cultural attributions are truthful. Misrepresentation of tribal affiliation, origin, or authenticity is a material breach of these Terms and may violate the Indian Arts and Crafts Act of 1990 (25 U.S.C. § 305 et seq.).
5. Prohibited Items
Listings of sacred or ceremonial objects, human remains, eagle feathers or migratory bird parts, items containing protected wildlife, and items regulated by NAGPRA are strictly prohibited. NativeMade uses both automated review and manual moderation to enforce this policy and may remove any listing at any time.
6. Payments & Fees
Payments are processed by Stripe, Inc. By transacting on NativeMade, you also agree to Stripe's terms. NativeMade charges sellers a marketplace fee disclosed at onboarding. Buyer payments are charged at checkout.
7. Shipping, Returns & Refunds
Shipping, returns, and refunds are governed by our Returns & Refunds Policy.
8. Intellectual Property
Sellers retain all rights to their work and grant NativeMade a limited, non-exclusive license to display listings on the Service. NativeMade name, logo, and site content are owned by NativeMade.
9. Disclaimers
The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, NativeMade disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, NativeMade's aggregate liability for any claim arising from the Service shall not exceed the greater of $100 or the fees you paid to NativeMade in the 12 months preceding the claim.
11. Termination
We may suspend or terminate your account at any time for breach of these Terms or to protect the integrity of the marketplace. You may close your account at any time from your account settings.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced via email or in-app notice at least 14 days before taking effect.
13. Governing Law
These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Santa Fe County, New Mexico.
